This is an action by an excess insurance carrier and its insured against the insureds primary insurance carriers. Appellants sued appellees alleging negligence and bad faith in connection with appellees investigation, evaluation, negotiation and defense of a jointly insured tort liability claim. Appellees moved to dismiss the case on grounds that appellants had failed to state a cause of action upon which relief could be granted. The trial court granted appellees amended motion to dismiss, and this appeal followed. In two points of error, appellants complain that the trial court erred in granting the motion to dismiss. We reverse and remand.
